Terms of Service

1. Service Description

APC AI Coach is an independent, AI-powered preparation platform for RICS APC candidates, operated by Tekton Thrive FZCO (the “Company”, “we”, “us”, or “our”), registered in the United Arab Emirates.

The service (“Service”) includes:

• AI-powered readiness scoring and competency gap analysis of your APC submission pack (case study, CV, Statement of Experience)
• A targeted question bank and downloadable PDF assessment report
• AI-powered mock interview practice with a simulated three-assessor panel and voice or text modes
• Follow-up question generation drawn from your submission content

The Service currently specialises in the Quantity Surveying pathway, with Building Surveying, Project Management, and Commercial Management planned.

2. Acceptance of Terms

By creating an account or accessing the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service. These Terms form a binding legal agreement between you and Tekton Thrive FZCO.

3. Account Registration

To access paid features you must register for an account. You agree to:

• Provide accurate, complete, and current information during registration
• Maintain the security of your password and account credentials
• Notify us immediately of any suspected unauthorised access at info@tektonthrive.com
• Accept responsibility for all activities conducted under your account
• Not share account access with any other person

You must be at least 18 years of age to register. By registering, you confirm you meet this requirement.

4. One-Time Payment Bundles

Access to paid features is provided through one-time purchase bundles, not subscriptions. There is no automatic renewal. Current bundle options are:

• Free: Limited access to core features at no cost
• Assessment Prep: Full submission pack analysis, AI readiness score, and mock interview access
• FIDIC Workshop Starter: Assessment Prep features plus FIDIC Workshop access
• FIDIC Workshop Pro: All features, priority support, and expanded usage limits

Access to bundle features is granted upon successful payment confirmation from Stripe. We reserve the right to modify bundle contents and pricing at any time. Changes do not affect bundles already purchased.

5. Final Sale

All bundle purchases are final. Because bundles unlock AI-generated outputs and interview sessions that consume real compute the moment they are used, we do not offer refunds once a purchase is completed. Please review the free tier and the pricing comparison page before buying to confirm a bundle meets your needs.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful, fraudulent, or unauthorised purpose
• Share your account credentials or grant access to your account to any other person
• Upload documents that contain malicious code, viruses, or content that infringes third-party rights
• Attempt to reverse engineer, decompile, or extract any proprietary algorithms or AI model weights
• Probe, scan, or test the vulnerability of the Service or its infrastructure
• Scrape, crawl, or systematically extract data from the Service
• Submit false, misleading, or fraudulent information
• Interfere with other users’ access to the Service
• Violate any applicable laws or regulations, including data protection laws

7. Intellectual Property

All content, features, software, and functionality of the Service (including AI models, prompts, scoring algorithms, report templates, and user interface design) are owned by Tekton Thrive FZCO or its licensors and are protected by copyright, trademark, and other intellectual property laws. No part of the Service may be reproduced, distributed, or created as a derivative work without our prior written consent.

You retain ownership of the documents you upload (case study, CV, SoE). By uploading content, you grant us a limited, non-exclusive licence to process that content for the sole purpose of delivering the Service to you. We do not use your content to train third-party AI models.

8. Disclaimers

APC AI Coach is an independent preparation platform and is NOT affiliated with, endorsed by, authorised by, or connected to the Royal Institution of Chartered Surveyors (RICS). RICS is a registered trademark of the Royal Institution of Chartered Surveyors. Use of the term “RICS” on this platform is solely to identify the professional qualification that the Service is designed to help candidates prepare for.

No guarantee of APC success

The Service provides preparation assistance. We make no representation or warranty that use of the Service will result in a passing APC outcome. APC assessment decisions are made solely by RICS and its appointed assessors. Readiness scores, feedback, and question banks are indicative only.

AI output is assistive, not authoritative

AI-generated feedback, competency scores, gap analysis, and interview questions are provided for preparation purposes only. They are not professional advice, not a formal assessment, and should not be relied upon as authoritative guidance on RICS requirements. RICS APC requirements change over time; always refer to current official RICS guidance.

Service availability

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or uninterrupted availability. We do not warrant that the Service will be error-free or available at all times.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Tekton Thrive FZCO and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or in connection with your use of the Service, including but not limited to:

• Loss of data, profits, or business opportunity
• Outcomes of RICS APC assessments or professional consequences thereof
• Reliance on AI-generated feedback or scores
• Service interruptions or technical failures

Our aggregate liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid to us in the 12 months preceding the claim. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be excluded by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Tekton Thrive FZCO and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your breach of these Terms; (b) your use of the Service in violation of applicable law; or (c) content you upload that infringes the rights of a third party.

11. Termination

We reserve the right to suspend or terminate your account at any time for material violation of these Terms, fraudulent activity, or non-payment. We will give reasonable notice where practicable, except where immediate termination is required for security or legal reasons.

You may close your account at any time through your account settings or by contacting us at info@tektonthrive.com. All purchases are final; closing your account does not trigger a refund. Sections 7, 8, 9, 10, 12, and 13 survive termination.

12. Governing Law

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the United Arab Emirates as applied in the Emirate of Dubai (onshore UAE law). Certain UAE mandatory laws apply regardless of any other governing law provision.

13. Dispute Resolution

In the event of any dispute, both parties agree to first attempt resolution through good faith negotiation. Either party may initiate this process by sending written notice of the dispute to the other party. The parties will have 30 days from the date of such notice to resolve the dispute informally.

If informal resolution fails, any dispute arising from or related to these Terms or the Service shall be submitted to the exclusive jurisdiction of the Dubai Courts (onshore), United Arab Emirates. Nothing in this clause prevents either party from seeking urgent interim or injunctive relief from a court of competent jurisdiction.

14. Changes to Terms

We may modify these Terms at any time. We will provide at least 14 days notice of material changes by email and by posting a notice on the Service. Continued use of the Service after the effective date of a change constitutes your acceptance of the revised Terms. If you do not agree with a change, you must stop using the Service before the effective date.
